The section titles in these Terms and Conditions ("Agreement") are for convenience only and have no legal or contractual effect. Explicit and implied terms within the current Terms and Conditions, Ning Privacy Statement and Ning Terms of Service, are binding upon visiting, registering for membership or any form of access to the Buzz site and related content.

1. No Businesses Allowed- The Buzz website and messaging platform are for not-for-profit use. Membership rights are granted to: (a) Individuals including musicians and band members for the purpose of sharing common personal interests and content, OR (b) Not for profit organisations. Membership rights are not granted to for-profit businesses. This Agreement shall remain in full force and effect while you use the Website, the Service, and/or are a Member. You may terminate your membership at any time.

2. No Ads Allowed - The Buzz website and messaging platform are ad-free and for individual use. Memberships may be terminated should a for-profit business or individual advertise in any form as, or on behalf of a business.

3. Profile Names and Profiles - Individual member profile names must be a personal name or nickname & not be an advertisement, email address or website URL. Profile names/accounts cannot be used by multiple users. Not-for-profit organisation profile names can include a personal name or nickname, yet must also clearly identify the organisation behind the profile. Your Individual profile should not include, last names, telephone numbers, street addresses or email addresses.  It is solely your responsibility, and not buzz or GMHBA’s to guard your identity, password and any personally identifiable data. This includes information that could lead to an understanding of yours or a third party’s identity. You may not post anybody’s private information without their consent. The Buzz services are maintained in Australia, however all data and access to content is transferred and processed through American hosting and proprietary services. Therefore by accessing Buzz you agree to have your information, profile and related data transferred and governed by all relevant United States laws, in addition to all relevant Australian legislation. Members’ access, information, and related content of people who are believed to be less than 13 years of age, may be deleted and banned future access without warning, however GMHBA has no responsibility to do so.

4. Email Usage, Cookies & IP Addresses - All GMHBA Limited (GMHBA) requires as operator of the Buzz website is a valid working email address in order to provide the Buzz service to you and this email address will not be sold, rented out or provided to any third party unless required to do so by law. GMHBA uses Google Analytics to analyse the use of this website. Google Analytics generates statistical and other information about website use by means of cookies, which are stored on users' computers. The information generated relating to our website is used to create reports about the use of the website. Google will store this information. Google's privacy policy is available at: http://www.google.com/privacypolicy.html As an additional security precaution IP addresses may be recorded for the purpose of enforcing this Agreement and the NING Terms of Service.

5. Acceptable Content - You are solely responsible for your profile images, photos, videos, text and external web addresses which must all be acceptable for general viewing for members aged 13+. Acceptable content is that which fully complies with both and comply with international and Australian copyright, libel and other laws.

6. Content Moderation - All areas of the Buzz website may be moderated & content deemed inappropriate may be removed without notice in accordance with this Agreement. Members are solely responsible for their actions, relationships, commitments, obligations, communications, and interactions with other Buzz Members. GMHBA reserves the right, but has no obligation, to monitor disputes between you and other Members. GMHBA is not responsible for any content you see or receive from any sites that are linked to or from the Buzz website and you access these sites at your own risk. It is advised you practice proper precautions when navigating away from the buZZ website. GMHBA is not liable for any issue that may arise from content, data or code, even if it is brought to their attention.

7. Don't Break It, And We Might! - Members must not interfere with the functionality of the Buzz website by removing or hiding navigation links. Your use of the Buzz service, and all code and content, are at your sole responsibility and risk. The Buzz website and all code and content are provided on an 'As Is' and 'As Available' basis. GMHBA expressly disclaims all representations, warranties, or conditions of any kind, whether express or implied, including but not limited to, the implied warranties or conditions of merchantability, fitness for a particular purpose, accuracy, system integration, quiet enjoyment, title, and non-infringement. GMHBA does not make any warranty that the Buzz website, or code, or content will meet your requirements or be uninterrupted, timely, secure or error-free. In addition to these Terms and Conditions, you must comply with all policies applicable to Ning Inc. and the Ning Platform.

8. Membership Termination - Breaches of this Agreement may result in membership profiles & content being removed without notice.

9. You Can't Blame Us!  - No content or links provided by members of Buzz are endorsed by either Buzz or GMHBA. In particular any and all health and welfare related information posted by Buzz members does not constitute medical or professional advice. The Buzz website is provided for entertainment only without assuming a duty of care. Neither GMHBA nor Buzz nor any people affiliated will either GMHBA Limited or Buzz will be liable in any way for any decision or action Buzz members take as a result of content on or related to the Buzz website. Any and all content on the Buzz website including any chatrooms, is deemed to be for entertainment purposes only. GMHBA strongly recommends you discuss any health related issues with your medical practitioner or other professional health service provider. You agree that GMHBA is not responsible for any loss or damage incurred as the result of any such dealings or with respect to any other User's use or disclosure of your Personal Data (as defined in the Privacy Policy). If there is a dispute between you and any third party (including any User), GMHBA is under no obligation to become involved. You release GMHBA, its officers, employees, agents and successors from claims, demands and damages of every kind or nature arising out of or related to: (i) any disputes with other Users, and/or (ii) the Buzz website. By participating in any event that may be posted on the Buzz website, you agree to release and hold GMHBA harmless from any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, either directly or indirectly related to or arising from your participation in any such Buzz event.

10. Content Can Continue - Anything you post or upload onto Buzz may appear elsewhere on the internet and/or remain on the internet after you have ended your membership on Buzz and you accept that while both GMHBA Limited as operator of the Buzz website and NING Inc. owners of the platform upon which Buzz is built, provide various privacy controls, neither GMHBA nor Ning Inc. can guarantee that your content won't appear elsewhere, be copied, downloaded or used otherwise. If you are concerned about posting or uploading any personal and/or private content, you are advised not join/use this social network!
